Article 1 – Definitions
In these terms and conditions, the following definitions apply:

  1. Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
  2. Consumer: the natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur;
  3. Day: calendar day;
  4. Extended transaction: a distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time;
  5. Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;
  6. Right of withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period;
  7. Model form: the withdrawal form provided by the entrepreneur that a consumer can use to exercise their right of withdrawal;
  8. Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers;
  9. Distance contract: an agreement concluded within a system organized by the entrepreneur for distance selling, using one or more means of distance communication;
  10. Distance communication technique: a means that can be used to conclude an agreement without the consumer and entrepreneur being physically present together;
  11. General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

If the entrepreneur exercises a regulated profession:

  • the professional association or organization to which they are affiliated;
  • the professional title and the EU/EEA country where it was granted;
  • a reference to applicable professional rules and where these can be accessed.

Article 3 – Applicability

  1. These terms apply to every offer and every distance contract between entrepreneur and consumer.
  2. Before concluding a distance contract, these terms will be made available to the consumer.
  3. If concluded electronically, these terms can be provided digitally for storage on a durable medium.
  4. If additional product/service conditions apply, the most favorable provision for the consumer applies in case of conflict.
  5. If any provision is invalid, the remainder remains valid and will be replaced accordingly.
  6. Situations not covered shall be interpreted in the spirit of these terms.
  7. Ambiguities shall be interpreted in the spirit of these terms.

Article 4 – The Offer

  1. If an offer has a limited validity, this will be stated.
  2. The offer is non-binding and may be adjusted.
  3. The offer includes a complete and accurate description of products/services.
  4. Images and specifications are indicative and may not lead to claims.
  5. Colors shown may differ from actual products.
  6. Each offer clearly states rights and obligations, including:
  • price including taxes;
  • shipping costs;
  • how the agreement is concluded;
  • whether withdrawal applies;
  • payment, delivery, and execution methods;
  • validity period;
  • communication costs;
  • archiving of the agreement;
  • data verification options;
  • available languages;
  • codes of conduct;
  • minimum duration in case of extended transactions;
  • optional: sizes, colors, materials.

Article 5 – The Agreement

  1. The agreement is concluded upon acceptance and fulfillment of conditions.
  2. Electronic acceptance will be confirmed immediately.
  3. Secure technical measures are applied for electronic transactions.
  4. The entrepreneur may assess the consumer’s payment ability.
  5. The entrepreneur provides key information upon delivery.
  6. For extended transactions, this applies to the first delivery only.
  7. Agreements depend on product availability.

Article 6 – Right of Withdrawal

For products:

  1. The consumer may cancel within 14 days after receipt.
  2. The product must be handled carefully and returned in original condition.
  3. The consumer must notify within 14 days and return within 14 days.
  4. If deadlines are exceeded, the purchase is final.

For services:

  1. The consumer may cancel within at least 14 days after agreement.
  2. The consumer must follow provided instructions.

Article 7 – Costs in case of withdrawal

  1. Return costs may be charged to the consumer.
  2. Refunds are issued within 14 days after return.
  3. Damage caused by misuse may reduce value.
  4. No liability if required legal info was not provided.

Article 8 – Exclusion of withdrawal

  1. Withdrawal may be excluded if stated clearly.
  2. Applies to custom-made, personal, perishable, sealed, or hygiene products.
  3. Also applies to specific services and events.

Article 9 – Pricing

  1. Prices remain stable unless VAT changes.
  2. Variable pricing may apply to market-dependent products.
  3. Price increases allowed under legal conditions.
  4. Prices include VAT.
  5. No liability for typographical errors.

Article 10 – Conformity and Warranty

  1. Products meet agreement and legal requirements.
  2. Warranty does not affect legal rights.
  3. Defects must be reported within 4 weeks.
  4. Warranty aligns with manufacturer warranty.
  5. Warranty does not apply in cases of misuse or modification.

Article 11 – Delivery and Execution

  1. Orders are handled with care.
  2. Delivery is made to the provided address.
  3. Delivery occurs within 30 days unless agreed otherwise.
  4. Average delivery time: 2–3 business days.
  5. Address details may be shared with suppliers.
  6. Delivery times are indicative.
  7. Refunds are issued within 14 days if canceled.
  8. Replacement items may be offered if unavailable.
  9. Risk transfers upon delivery.

Article 12 – Duration transactions

Consumers may cancel ongoing agreements with a maximum notice period of one month.

Article 13 – Payment

  1. Payments must be completed within 7 days unless agreed otherwise.
  2. Consumers must report incorrect payment details.
  3. Costs may apply in case of non-payment.

Article 14 – Complaints

  1. A complaints procedure is available.
  2. Complaints must be submitted within 7 days.
  3. Complaints are handled within 14 days.
  4. If unresolved, disputes may arise.
  5. Consumers should first contact the entrepreneur.
  6. Valid complaints may result in repair or replacement.

Article 15 – Disputes

  1. Dutch law applies.
  2. The Vienna Sales Convention does not apply.

Article 16 – Privacy

  1. 24goodz.com handles your data with care.

Article 17 – Additional provisions

Additional provisions must not disadvantage the consumer and must be documented.
